Terms of Sale

1. Who may order

Orders are accepted from researchers, laboratories and institutions who are at or above the age of majority in their province or territory, and who are legally entitled to purchase, receive, possess and handle the materials ordered. We may refuse or cancel any order, at our discretion, where we have reason to believe these conditions are not met.

2. The research-use condition

All material is sold strictly as a reference material for in vitro laboratory research and analytical use. By ordering you make each of the representations set out in the research use disclaimer, which forms part of these terms. Breach of any of them is a fundamental breach of this contract.

3. Orders and acceptance

A listing on this site is an invitation to treat, not an offer. Your order is an offer to buy, and a contract is formed only when we confirm the order in writing. We may decline an order for any lawful reason, including stock availability, a pricing or description error, or concern about the use to which material would be put.

4. Prices and taxes

All prices are in Canadian dollars and exclude applicable taxes. GST, HST, PST or QST is applied at the rate for the shipping province and is shown before an order is confirmed. Prices may change without notice; the price that applies is the one confirmed on your order.

If a price is listed in error, we will tell you before accepting the order and you may confirm at the corrected price or cancel without charge.

5. Payment

Payment is due in full before dispatch, by the method set out on the payment link issued with your order confirmation. Card details are entered with the payment processor and are never received or stored by Onex Peptides. Institutional purchase orders and invoicing are available by prior arrangement; see bulk and institutional supply.

6. Delivery

Orders are dispatched from British Columbia, Canada to Canadian addresses only, and shipping is free on orders over CA$200 before tax. Delivery estimates are estimates and not guarantees; we are not liable for delay caused by a carrier, by weather or by any cause outside our reasonable control. 7. Title and risk

Risk passes to you on delivery. Title passes when payment has been received in full. Where a parcel is lost or damaged in transit, the remedies in the shipping policy apply.

8. Inspection

Inspect your order on arrival. Damage, shortage or a wrong item must be reported within five days of delivery, with photographs where damage is claimed. After that period the order is taken to have been accepted as delivered.

9. Returns and refunds

Governed by the refund policy, which forms part of these terms. In summary: unopened vials in original condition may be returned within fourteen days; opened or reconstituted material cannot be accepted back under any circumstances, because its storage and handling after delivery cannot be verified.

10. Specification and conformity

Material is supplied against the release specification stated on its product page, and each lot ships with the certificate of analysis produced from that lot. A claim that material does not conform must identify the specification said to be unmet and will be assessed against the certificate for that lot.

Beyond that specification, and to the fullest extent permitted by law, all implied warranties, conditions and representations — including those of merchantability and fitness for a particular purpose — are excluded. No warranty of any kind is given as to suitability for any research application, which is a judgement only the researcher can make.

11. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with any order is limited to the amount paid for that order.

We are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data or research results, however caused.

We accept no liability whatever for loss, injury or damage arising from use of any product contrary to the research-use condition in clause 2. Nothing in these terms excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify Onex Peptides against any claim, loss or expense arising from your breach of these terms, from your use or handling of material supplied, or from your onward supply of it to any third party.

13. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it, and the courts of British Columbia have exclusive jurisdiction. If any provision is held unenforceable, the rest remains in force.
